1. About These Terms

Bloom: Sleep Garden (the “App”) is made by CLAD Ventures LLC, an Indiana limited liability company (“we,” “our,” or “us”). Your license to use the App comes from Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms of Service add to it for the parts of Bloom we run ourselves: accounts, Friends features, garden items and Bloom Plus. If the two conflict about the license to the App, the Standard EULA applies.

By using the App you agree to these terms and to the Standard EULA. Our Privacy Policy explains how we handle your information. If you don’t agree, please don’t use the App.

2. Who Can Use Bloom

You must be at least 13 years old to use Bloom. If you are under 18, or under the age of majority where you live, a parent or guardian must agree to these terms for you and is responsible for your use of the App, including purchases.

3. Bloom Is Not Medical Care

Bloom is a game and a wellness app. It is not a medical device, and it does not diagnose, treat or prevent any condition. Your Bloom Score, sleep insights and tips are estimates based on what your sleep tracker, or your iPhone’s time in bed, saves to Apple Health, and they can be wrong. When Bloom has only your iPhone’s time in bed, the sleep it counts is an estimate too. Don’t use any of them to make medical decisions. If you have concerns about your sleep or your health, talk to a doctor.

Alarms, reminders and sleep sounds depend on your iPhone: its iOS version, volume, Focus and notification settings, battery and whether the App was closed. We work hard to make them reliable, but we can’t guarantee they will always go off. When waking up on time really matters, set a second alarm.

4. Your Account and Friends

You don’t need an account to play. Friends features need one, which you create with Sign in with Apple or Sign in with Google. Keep your sign-in secure, and use your account only for yourself. You are responsible for what happens on your account. You can change your display name at any time and your username once every 30 days.

Your friends can see your display name and username and, depending on your settings, your garden and your streak. Bloom has zero tolerance for objectionable content and abusive users. Don’t use names, or anything else you share, that:

  • are hateful, harassing, threatening, sexual or violent;
  • pretend to be someone else, or include someone’s personal information;
  • infringe someone else’s rights, such as their trademark; or
  • advertise or spam, including repeated unwanted friend requests or gifts.

You can decline any friend request, and you can block or report someone in the App from their page, their friend request or a search result. Reports come to us. If a name or someone’s behavior breaks these rules, we may remove or change it and may suspend or delete the account responsible, without notice.

5. Garden Items and Purchases

Petals, water, seeds, flowers, decorations, streaks, gifts and the other things you earn or collect in Bloom are part of the game. We give you a personal, limited license to use them in the App. They have no cash value, you don’t own them, and they can’t be sold, traded or exchanged for money or anything outside the App. You can give them to friends only through the App’s own gifts.

To keep the game fair and fun, we may change how items, rewards, prices in petals and other game rules work, or remove items. Your garden is stored on your iPhone, not on our servers, so if you delete the App we can’t restore it. A backup of your iPhone made with Apple’s tools may include it.

Bloom Plus (a subscription), the animals’ looks, garden scenes and the scenes bundle are bought through the App Store. Apple handles payment, renewals and refunds under its own terms, and we don’t receive your payment details. Bloom Plus renews automatically until you cancel it in your App Store account settings, at least 24 hours before the period ends. Refund requests go to Apple. We may change what Bloom Plus includes or its price; if a change takes something away or raises the price, we’ll tell you in the App before it applies to your next renewal, and Apple will ask for your consent where it requires.

Bloom Plus includes every garden scene while your subscription is active. Scenes you buy are yours to keep; scenes you have only through Bloom Plus go back to the usual sky when it ends.

6. Fair Play

When you use Bloom, please don’t:

  • change your iPhone’s clock or enter sleep that didn’t happen to earn rewards;
  • use bugs, bots, scripts or modified versions of the App to gain items or progress;
  • copy, decompile or reverse engineer the App, except where the law allows it;
  • access our servers other than through the App, or try to reach other people’s data; or
  • disrupt Bloom or other people’s use of it.

If we find items or progress gained this way, we may remove them.

7. What’s Ours and What’s Yours

Bloom’s name, art, sounds, music, text and code belong to us or our licensors and are protected by law. These terms don’t give you any right to use them outside the App.

You keep any rights you have in the names you create. You give us permission to store them and show them to your friends so we can run the Friends features. If you send us ideas or feedback, we may use them without paying you or owing you anything.

8. Ending Things

You can stop using Bloom at any time, and you can delete your account in the App (Settings → Friends → your name → Delete account). Deleting your account doesn’t cancel Bloom Plus; cancel it in your App Store account settings. We may suspend or close your account if you break these terms, if the law requires it, or if we stop offering Friends features or the App. If we stop offering a feature you paid for while your Bloom Plus subscription is active, we’ll tell you first.

9. Disclaimers and Liability

To the extent the law allows, Bloom and its online services are provided “as is” and “as available.” We don’t promise they will be uninterrupted or error-free, that your progress will never be lost, or that sleep information, scores or alarms will be accurate or timely.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or progress. Our total liability to you for any claim about Bloom is limited to the greater of the amount you paid for Bloom in the 12 months before the claim and US$50.

Some places don’t allow these limits. Nothing in these terms limits rights you have as a consumer that can’t be limited by agreement, such as consumer rights in the European Union or the United Kingdom, or our liability for fraud or for death or personal injury caused by our negligence.

10. Disputes

If you have a problem with Bloom, please email us first at info@clad-ventures.com. Most problems can be fixed that way, and we’ll both try in good faith for 30 days before going to court.

These terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Indiana, and you and we agree to their jurisdiction. Either of us may bring a claim in small-claims court instead. If you are a consumer living outside the United States, you keep the protection of the mandatory laws of your country and may bring a claim in its courts.

11. Changes to These Terms

We may update these terms as Bloom changes. We’ll change the date at the top, and for important changes we’ll also tell you in the App. If you keep using Bloom after the changes take effect, the new terms apply. If you don’t agree, stop using the App and delete your account.

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later.

The Short Version

Bloom is a sleep game, not medical advice, and a second alarm is a good idea when it really matters. Be kind with names and in your friends’ gardens. Garden items are for playing, not for selling. Purchases go through Apple. Play fair, and we’ll keep working to make Bloom fair, too.
